Online Casino News: Lawsuit for
Online Casinos Heard

As online casino proponents around the
world waited with baited breath, the
iMEGA lawsuit was heard this week in the
Third Circuit Court of Appeals in
Philadelphia. Known as our nation’s
birthplace, Philadelphia seemed like the
perfect place for many online casino
gamblers to see their dream of freedom
to gamble online realized.
The online casino group iMEGA was
seeking to have the Unlawful Internet
Gambling Enforcement Act, or UIGEA
overturned for “vagueness” and according
to their president, Joe Brennan, the
court was truly listening to them. He
said that the judges had obviously spent
their time with the issue and asked a
lot of questions of both sides. They
asked things regarding to the online
casinos, how they were played, and where
the actual bet is considered to take
place.
Government attorney’s spent their time
attacking iMEGA saying that they did not
have the right to represent the online
casino industry. They seemed to waste a
lot of time hammering on this topic,
when it was already ruled on that they
did have the right. The court panel
asked many more questions of the online
casino group than they did the
government, and Brennan said that he was
not sure whether this was a positive or
negative sign for their case.
They also questioned the progress of
pending legislation in regards to the
bills that Rep. Barney Frank was pushing
through. They left it up in the air and
said that they would discuss it and get
back with their ruling, which means that
they could either leave it pending until
they see what goes on with Frank’s bill,
or they could rule within 90 days.
