Rematch Goes to Online Casinos
So all of that panicking may have been
in vain? It would seem so. The Kentucky
Court of Appeals has ruled in the online
casino industry’s favor, and has
released the online casino domain names
from the state’s grasp.
Back in October, Kentucky won the right
to seize 141 online casino domain names.
Kentucky governor Steve Beshear said
that if they were allowing Kentucky
residents to participate in online
casino gambling then they were breaking
the law and endangering the financial
positions of their residents. He also
admitted that he was protecting the
state’s gambling industry by keeping out
online casinos.
He lost the first round to the online
casino community when the judge told him
he could not take the site names. Then
he won the second round when the judge
ruled he could. Now he has lost the
third round in the Kentucky Court of
Appeals and is vowing to appeal to the
State Supreme Court.
The court said that although the sites
promoted online casino gambling, the
domain names themselves did not have
anything to do with that. They said that
under Kentucky law the actual names are
not devices of gambling and therefore
are not open for seizure. The online
casino community was thrilled with the
decision leaving them 2-1 in the court
case system. We can expect that if they
should lose the fight at the State level
that they will appeal it as well, and
the same goes for the state of Kentucky.
