North Carolina Debates Gambling

Like other states within the US, North Carolina is debating legalizing video sweepstakes games. Governor Beverly Perdue signed a new law that banned sweepstakes games in the state. It seemed like decisive action making the hobby illegal and changing the climate of online gambling. Now, the governor seems to have backtracked a bit by confirming that she would be willing to hear proposals on legalizing video poker. Part of the issue is that legislators in North Carolina want to reform the state’s Alcoholic Beverage Control methods and part of that starts with reworking gambling. The ban on tradition poker machines was the governor’s first step in controlling alcohol and by no means is she done with the issue. It will take time for legislators to adopt the adequate rules that change the world of gambling. But now that the governor seems more open to new ideas, that changes things entirely.

Almost every state is debating the issue of online gambling and trying to implement some way of capitalizing on the millions of tax-revenue dollars involved. If one thing is for sure, people will gamble. This was proven with the UIGEA that caused millions of US gamers to move to offshore companies for their gambling needs. It cost the US billions of dollars and was a mistake that won’t be lived down any time soon. Now, states are all coming together to try to write laws that legalize and regulate gambling. They know that it is a lucrative pastime and their suffering budgets can surely benefit from it. Since the recession, people have suffered and so have state and county budgets. Now they are hoping that the new legislation they come up with regarding gambling might help to shore up diminished state coffers and help them to overcome the huge deficits they are trying to manage.

It will take time for North Carolina and the governor to come up with a viable legislation to manage online gambling, but most likely it will happen. With the Governor’s newfound willingness to look at new rules, it seems as if gambling is just a matter of a few months away for residents of the state.

 

North Carolina’s Internet Cafes Hold Sweepstakes

North Carolina has been embroiled in the issue of gambling for some time now. The sides drawn are not unlike those of other states—on one side there is the ethics-based groups who believe that the move is a sure-fire way to bring in problems for the state and on the other side is a legislative branch that believes that the money available is too much to turn down.  Ethics-based groups believe that gambling within the states will bring in crime, corruption, money laundering and a greater need for addiction resources. Legislators however, see the huge dollars that are available with legalization and regulation of gambling and are pushing hard to make it work. They are currently writing and rewriting laws to bring in millions of potential gambling-tax dollars.

In North Carolina, the gambling issue is now settled, however the issue of internet café gambling is now at the forefront. Though video gambling machines have been banned and cited as illegal, internet café gambling isn’t. The state’s Court of Appeals recently clarified that video gambling machines are illegal. They cited poker machines as illegal to use within the states and any bar or pub using them had to immediately get rid of the machines. Though the ruling was thought to be thorough, it left one gaping oversight—the question of internet cafes where customers are allowed to play for a sweepstakes game once they buy internet time or a phone card. When customers purchase either, they have, by contract, the right to play the sweepstakes games on their computer. The games are poker-like in nature and they are legal according to operators because the games offer players the chance to win a prize, rather than cash. Mostly operators are offering customers the chance to win a prize that promotes their brand, product or service.  Owners are divided on the issue and many believe that it is just another form of gambling and should be illegal. Thus far, law enforcement officials have been told to let internet cafes continue their sweepstakes activities until a ruling is officially made on the issue. These sweepstakes are popular within the state of North Carolina and are showing no signs of waning.

NC Fights a Ban on Video Gambling

North Carolina is in the midst of debates over video gambling. Like many other states it is looking for new revenue generating activities to shore up coffers. The recession had an adverse affect on all jurisdictions. Spending was down due to the heightened unemployment rate and economies suffered greatly. Now that the recession is over, markets are still in the midst of clean-up. They are trying to come up with funds and gambling keeps coming up as a viable option. Though there are sides to the issue fighting vehemently, it looks like one court battle after another is dictating how monies will be found.

This past Tuesday gambling operators in North Carolina heard a court ruling they were not looking for. The Court of Appeals panel of three judges upheld a state-wide ban on video gambling machines. The legal battle began when the state banned video gambling machines around the state, but contradicted itself by allowing them on an Indian reservation. The mixed message was what operators took task with and Superior Court Judge Howard Manning agreed. He ruled that the state could not ban the machines, but allow them at tribal casinos.
Although there was a victory for gaming operators, later Manning put a stay on his ruling. Unfortunately, the appeals court overturned the decision. Senate leader Marc Basnight said, “This is great news. We worked for so long to try to rid our state of this awful industry. I am very pleased that the Court of Appeals decision will uphold the ban passed by the General Assembly.” The state is now embroiled in the issue of whether or not to allow video slot machines. It is also setting the stage for other state’s battles over the issue. Alabama is the next state weighing in on the topic of video gambling. Many operators have already challeneged former rulings and are hoping to turn things around in a battle with the Supremem Court. Regardless of what happens, the reality is that video gambling is causing a huge stir in markets throughout the US. Only time will tell whether or not it is allowed or banned.
