Once the player realized he won, he was stopped prior to payout. It was only until then that the casino checked his name and found him to already be signed up on the self-exclusion list. The incident made headline news though because it shows a flaw in the system. If one person who self-admittedly has a problem requested that state casinos deny him or her access and that system failed, how many more times has it failed? If the system is allowing gamblers to play despite their wishes, then the rules need to be revisited for modifications. Some opponents of gambling in the state are citing this one incident as a sign that things are not working. Though the communities cannot go back on their laws, they can reword them.
One of the primary focuses of writing gambling laws was to protect players. Opponents cited that bringing legalized gambling into communities may be too much of a temptation for gamblers. Their primary issue was how casino operators were going to protect addicts and build safeguards to help them with their problem. Would casinos be able to police those with potential problems? Would casinos be able to keep them off of the casino floor? Would the system work, or were operators just pushing for the laws to go through so they could start collecting money?
The other issue with people on the self-exclusion list being able to gamble is that if they are, they are gambling with no possibility of winning. A player could wager hundreds, even thousands, before he or she wins and the casino is aware of their position. That means the casino would take the wagered money from players who have no chance of walking out of the casino with a win. It’s a win-win for the casino. If a player on the self-exclusion list wins, the casino operators could refuse legally to pay them on the grounds that they should have not been wagering in the first place. It is a deep issue and obviously not a well thought-out one. It will take time to shore up rules and ensure that those who don’t want to gamble are not allowed onto the casino floor.

Quite possibly regulators didn’t know what they were getting into when they first were tasked with writing laws that would legalize and regulate gambling when playing at a casino online. It is proving to be a daunting task with a lot of passionate arguments on each side of the picture. On one hand proponents believe that the level of tax-revenue dollars that could be brought into the communities is impossible to pass up. They believe that with the proper regulation, the problems of crime and corruption will be minimized. Then there is just as strong an opposing group. They believe that the crime and corruption potential is too big a risk for communities to handle. They are taking a much more ethical stand, believing that the amount of problems a community has will be too hard for them to manage. They also cite the growth in gambling addictions too high a price for any community to pay and the limited number of Gamblers Anonymous locations throughout the US as an additional problem.
Pennsylvania is a state that is in the midst of the exact arguments and debates over the issue. The state’s legislators are debating the regulation of gambling and how they can make it work within the borders. Though regulations are already being followed, recent events have proven that there are some problems with them. At the Presque Isle Downs and Casino one player gambled on a machine and found himself in line for the jackpot. This would have been a normal everyday occurrence had one thing not been true: the player was already signed up on the casino’s “self-exclusion list.” This is a master list every casino is required to maintain and it is full of players who have gambling addictions and want to be denied access to casinos. They sign up their own names and theoretically the casino should turn them away at the door. It was a safeguard built into the system that was one of the reasons why some legislators agreed to legalizing gambling. They believed that with the right rules in place, it would work without a glitch. Unfortunately, that day in Pennsylvania the system didn’t work.

Traditionally those who have gambling addictions are the ones who are wagering the most over time and the ones who have the hardest time walking away from a table. They are the “big spenders” who sit at casino tables and wager for hours. What casino would turn down that kind of return—especially with a given “out” if they happen to win? It is an ethical issue in the end. Should a casino be able to take money from players who they know they can’t pay? It seems like a sure-fire way of taking advantage of players and taking their money without conscience. Legislators are working to change things though. They want to reword the self-exclusion laws and make them more realistic. They want the casinos to be more vigilant in checking the names and truly not allowing those on the list entry to their casinos.
This is just one of the rules and regulations in Canadian gambling that need to be rewritten. It will take time, but gambling is popular enough that operators have a good idea of where the problem issues are and what needs to be changed. It is now up to those operators to make good on their promise to “protect” the gambling public…even if it means that they are ridding themselves of hundreds, even thousands, of dollars in revenue. The money is at the expense of players who have already asked for help by being put on the self-exclusion list in the first place. They should be given the protection they asked for and casinos should have extra checkpoints where gamers can be turned away if necessary.
In the future expect casinos to have additional rules regarding all their procedures, and that includes the self-exclusion rules. It obviously isn’t working for players with addictions and that is a major fault. It means that legislators have to create laws that govern how a casino checks players as they enter the casino and various rooms of the location. It is clear that casino operators are not vigilantly watching now and that is going to be a necessity as things move in the world of gambling.

Just like the rest of the world Canada is weighing out its gambling options. The country is hoping to legalize and regulate gambling successfully but it already is having problems. Studies are showing that a record number of residents are moving forward with gambling. The market is growing exponentially and that means that it needs to be ready for the huge surge in customers. Over the past few months the recession has made it difficult for gamers. A lack of discretionary funds has made gambling a low priority on the list of activities. People had to cut back on spending, vacations, luxuries and of course gambling. It made things difficult for operators and many had to tap into their cash reserves to survive. Canada is the same—operators have been struggling and now legislators are pushing for rewriting of codes.
One of the main problems is that the current rules being followed are not sufficient to protect players, according to lawmakers. They believe that an immediate rewording of laws needs to happen before more people are hurt financially and emotionally. In question are the “self-exclusion laws.” In these laws, casinos are to maintain a list of gamblers who believe that they either have addictions or could have addictions. Their names are then checked on a list and they aren’t allowed entry to the casino. This opting out of casino gambling is a good move—if it worked. Unfortunately throughout the past it has failed. More than a few players who were on the self-exclusion list were allowed entry to casinos in the various provinces of the area. They played games and one even won. Gaming critics say that casino operators will maintain the self-exclusion list, but few are eager to follow it. It is a great way for a casino to continue taking a player’s money and then have an immediate out if he or she wins. They can fall back on the law that says they should not have been at a casino table to begin with and therefore are not eligible for the win. Of course they would be informed of this after spending hundreds, maybe thousands, at the casino’s various games. It’s a win-win situation for gambling operators to be lax in enforcing the self-exclusion rules at the door. Once rules are made safe for gambling addicts, then online casinos will be the next target.

Since the recession states throughout the US have been scrambling to shore up their gambling laws and regulations. Texas is in the midst of the same changes most of the country is. A new report done on the state is showing that about 75% of residents are in favor of legalizing and regulating gambling. That’s a huge victory for legislators who have been pining for the change. There has always been a 50-50 divide over the issue. On one hand you have legislators and residents who believe that gambling will do nothing more than bring crime, corruption, money laundering and more traffic congestion. They believe that the necessary laws and regulations are not in place to handle a full-out move to total legalization of gaming. On the other hand you have legislators who believe that the money afforded by legalizing and regulating gambling is a huge incentive to make the changes in laws. They believe that with the proper regulation, legalizing gambling should not be a problem. They are pushing hard for those changes and revamping of the regulations.
Texas, just like other states, is still debating the changes out. The legislators are hoping to walk the fine line between accepting gambling as a legal activity, while still protecting all parties involved. The Rasmussen Survey done on residents of the state showing that three-fourths of the communities are in favor of gambling prove that possibly the communities are ready for the change. Most people surveyed stated that their reason for supporting the changes is the creation of jobs for local communities and the amount of potential revenue via tourism it would bring in. Since the recession, it has been hard on families who want to get by financially. Many are still out of work and seeing the creation of gambling locations is a positive move that would help hundreds, even thousands, of workers who are unemployed to find manageable and reachable employment. Only time will tell where Texas will go with this new information stating that people want the change, but most likely it will prove a positive change for all parties involved.

Taking priority on the books of legislators is the issue of legalized gambling. Legislators are moving quickly to revamp the old laws, namely the UIGEA, or Unlawful Internet Gambling Enforcement Act. This was an act put into motion back in 2006. The act named gambling activities online illegal and tasked banks with policing, flagging and stopping all activities. Unfortunately, that threw an additional cost onto the banks because then they had to hire extra help and install new software that detected illegal gambling activities. There was a big problem though—banks were well aware that since they were responsible for gambling activities, they would incur huge penalties and fees if they let some activities slip through their cracks. Because of this, banks got overzealous in their denying activities. In fact, activities that should have been legal were stopped by banks for fear of infringing on federal rulings against them. Lotteries and various non-profit gambling activities that should have been deemed legal were turned away instead.
The UIGEA proved to e ineffective in other ways too. Though the bill was concerning online gambling, it never defined what exact activities fell under the heading of “gambling.” Did that mean everything that involved “chance” and potential payouts? Did it involve any RNG-based (or random number generator) activity that paid out monetarily? No one bothered to answer these questions prior to writing the UIGEA’s code or after. That left legislators in a quandary when things had to be revisited. No one ever defined gambling and now legislators are hard-pressed to rethink the things they left out of the UIGEA and how to best implement a more ubiquitous code for future generations to work off of.
You can expect that legislators are going to be working hard on the new code that is going to run gambling law. States and cities throughout the US are pining hard for legalized and regulated gambling activities. They know the millions of potential tax-revenue dollars that are available if the plans go through. After a difficult recessionary period, it is next to impossible to ignore the possibilities of bringing in so much revenue on a consistent basis over the next few decades.
